The Indian Express reported in September that the two Commissioners had formally recorded objections at least 14 times over about 10 months.

The Election Commission has rejected the suggestion that those internal exchanges establish unlawful unilateral decision-making.

What Are the Petitioners Asking For?

  • suspension of CEC Gyanesh Kumar from performing his functions while the issues are examined;

Article 324(5) of the Constitution protects the Chief Election Commissioner from ordinary executive removal.

The CEC cannot simply be dismissed by the government because of political disagreement.

The petitions now before the Supreme Court raise a different and more immediate question: whether the Court should grant interim or investigative relief concerning Kumar's functioning while allegations about the Commission's decision-making are examined.

The existence and scope of any such judicial power may itself be argued before the Court.
